Defense Witness: Christopher Kist

Direct Exam: Lindsey Gutierrez

He lives in Alexandria, Ky. and is married to Dana Parker-Kist. He is a physiologist at Children's Hospital and is an adjunct professor at Cincinnati State.

He played baseball with Ryan when they were at Miami University, then they moved into an off-campus apartment and lived together during their junior and senior years. He's known Ryan since 1999 and met Sarah Steward when she started working with Dana at the dentist's office. She spent a lot of time at their house before she met Ryan.

He said he spent a lot of time with Ryan during college and after graduation and they are still very close. He said he and Dana still spend a lot of time with Ryan. Sarah and Ryan were great together; "They were a great match for each other...hit it off from day one. They just clicked, they were a good fit."   He added, that Ryan adored her and he never saw any marital problems between them. He also said they never talked hateful to each other.

He went on to say that Ryan didn't show his emotions much. The most he had ever seen him upset was when he heard the 911 call, he said it was "quite upsetting."

He saw Ryan drink occasionally, but wouldn't describe him as having a drinking problem. Sarah bought him a kegerator for his birthday so they would have it when they had people over.

He went to Bengals games with Ryan--they had season tickets--but Sarah and Dana only went occasionally.   He recalled seeing Sarah fall asleep while tailgating once. She climbed into the back of the SUV and went to sleep. He also recalled her falling asleep at their house while watching a move. They wouldn't go out to see a movie because Sarah couldn't make it through without falling asleep. He was good friends with Ryan and his wife was good friends with Sarah.

Gutierrez asked if Ryan liked Motley Crue and he said that in the time they spent together, Ryan never listened to Motley Crue. They both like Rock 'n' roll.

He said he went to Jill Widmer's house to watch football with Ryan and Aryn. The Bengals played the Bears, and the Bengals "crushed them".   He definitely remembered that, he said. They had a few beers while they watched the game but Ryan wasn't drunk; he was his usual normal self.

He's been to Jill's house many times and there is a basement but there's no computer down there. The only computer is upstairs and it has a slow dial-up connection. He was at Jill's house on Oct. 26, 2009 and there was still no computer in the basement. Gutierrez asked if he remembered what he did on Oct. 26 (the night Ryan made the alleged phone call to Crew) - he said he helped move a chair from a storage unit to Jill's home and stuck around until around 8:15 p.m. He said he remembered it because it was the day after the Bengals "crushed" the Bears.   Nothing further.

Cross Exam: Travis Vieux

Vieux began by asking Kist if he ever spent one-on-one time with Sarah; he said he didn’t because she was more his wife's friend and Ryan was his friend. He said he never saw Sarah fall asleep during dinner in public, and she didn't fall asleep during Ryan and Sarah's first date, a double date with him and his wife. He didn't go out drinking with Ryan and Sarah. When he met Ryan, he knew Dana but wasn't dating her yet. They all three knew each other in college and he knew Ryan when he started dating Dana. Dana met Sarah in 2006 and she was primarily his wife's friend.

Vieux asked if there's a TV in Jill Widmer's basement;   he said there is.

Regarding the Bengals tailgating parties, Kist said they would come early and drink and grill until game time; he said he didn't sit with Ryan and Sarah during the game, so he doesn't know if she slept during the game.   Kist said he, Zoz and Ryan would watch Bengals games at Ryan and Sarah’s house and Vieux asked if the group of friends drank. He said yes, that' s what the kegerator was for.

In Oct. 2009, when he was at Jill's house, he said Ryan was not drinking. He didn't know if Jill was drinking.  

Vieux asked if he was at Ryan's house on Aug. 11, 2008, the night Sarah died, and Kist replied "I didn't need to be there to know he didn't do it".

There was a hush over the courtroom.   Nothing further.
