Is Hutzel above the law?

Hutzel said her office thinks the speedy-trial rules do not apply and that her office must take Widmer to trial in a "reasonable time."

Actually, in reality, the prosecutor is not only above the law, she is the law. She can not legislate laws but she is the most powerful person in the criminal justice system who can manipulate those laws that have been legislated.

The prosecute has the power of "discretion". She can choose not to prosecute criminals like those who ruined my life while choosing to prosecute the innocent IF she thinks she can get a conviction. Fortunately they failed in my case to convict me but the four criminals who victimized me have had the protection of the prosecutor's office as prosecuting them (IMO) would have shown the incompetence of the prosecutor's decision making.

In response to "named280" I must point out that Warren County is a short drive from Hamilton county. Lebanon is a great town to visit with restaurants and shops that should not be avoided because of a faulty broken criminal justice system. Good people live in that county. Warren County is a great place to live. I live in Hamilton County and the main thing keeping me from living in Warren County is that I have spoken the truth about a broken system. That can not be healthy for me if/when I am vulnerable to bad people in powerful places.

Remember what happens to people who do not stand up for those innocents harmed by the "state". Eventually they will come for you and there will be no one left to stand up for you. i.e. Europe WW ll.

Judgement Day WILL come for her and she is ONLY drawing it out and it will draw more attention to HER FALL! There are STILL MORE that need to come forward.....they know who they are and what they need to do! A clear conscience feels so much better! Hang in there Ryan ~~ Wait and See what this will bring!!!

I read that too, Mike, and was flabbergasted!!! I think this woman is so cunning, calculating and arrogant that she thinks she can rework the laws of the State of Ohio to suit her own purposes!! What unmitigated gall !!!!! smilies/angry.gif

I found this info about a speedy-trials So I hope the thorn in her side is very painful for her if this is to be true about speedy-trials

A defendant charged with a felony has a right to a trial within 270 days and, when they are in custody, each day in jail counts as three toward that total. The speedy-trial provision has long been a thorn in the side of prosecutors, said John Murphy, executive director of the Ohio Prosecuting Attorneys Association. The correct calculation of the time alone can be problematic, he said. It's fairly unusual for defendants to refuse to waive a right to a speedy trial, but when they do, it throws a wrench into the works, Murphy said.
Under Ohio law, if a prosecutor doesn't meet the trial deadline, the defendant cannot be charged again.
